1. Acceptance of Terms

By accessing or using TradeAware ("the Service"), operated by Softaware Lab, you agree to be bound by these Terms & Conditions. If you do not agree, do not use the Service.

2. Description of Service

TradeAware is a trading automation tool that connects to your Interactive Brokers account via the IBKR Client Portal API. The Service provides strategy configuration, automated order execution, portfolio monitoring, and risk management features.

3. No Financial Advice

The Service is a software tool, not a financial advisor. Nothing in TradeAware constitutes investment advice, financial guidance, or a recommendation to buy or sell any security. All trading decisions are ultimately yours. You should consult a qualified financial advisor before making investment decisions.

4. Trading Risks

Trading financial instruments involves substantial risk of loss. You acknowledge that:

• Automated strategies can result in financial losses, including losses exceeding your initial investment.
• Past performance of any strategy does not guarantee future results.
• Market conditions, system outages, API failures, or software bugs may cause unexpected behaviour.
• You are solely responsible for monitoring your positions and the activity of the Service.

5. Your Responsibilities

• You must have a valid Interactive Brokers account and comply with IBKR's terms of service.
• You are responsible for configuring risk limits appropriate to your financial situation.
• You must not use the Service for any unlawful purpose, including market manipulation.
• You are responsible for the security of your Google account used to sign in.

6. Account Access

Access to the Service requires administrator approval. The administrator may revoke access at any time. Your IBKR credentials are never stored by TradeAware — authentication occurs directly in the IBKR gateway.

7. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Softaware Lab and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or trading losses arising from your use of the Service.

9. Indemnification

You agree to indemnify and hold harmless Softaware Lab from any claims, damages, or expenses arising from your use of the Service or your violation of these Terms.

10. Modifications

We reserve the right to modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the revised Terms.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without cause. Upon termination, your right to use the Service ceases immediately.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Finland, without regard to conflict of law principles.
